What to do ??

I have been seperated for 5 years now with joint custody of my two children(now ages 16 and 13). Financial offset has my paying $800 per month in child support. Originally both children spent 50% time in each home (have court order). Last year my son decided to live full time with my EX and now recently my daughter has decided to live full time with me.

What are my rights? am I able to reduce the child support to 50%? I know it will be a battle but I need the money to support my daughter. I am a single income Dad like most.

I think you would have to either have her agree to it or have a new court order done. You cannot just decided to do it on your own.

as for the formula I am thinking but I am not sure, you would have to figure out how much she would pay for the one you have, you figure out how much you pay her for the one she has.

Offset child support, your full rate for one vs her full rate for one would be the guideline way to handle ongoing support.

Depending on what you have done in the past year, there may be arrears which you should be cautious of.

Thanks... that puts me at about $500. How would I calculate the arrears for when my Son was 100% living with my EX and Daughter was 50%?

I just want to be fair and have no surprises. If I have to court I will be doing it on my own as I can not afford a Lawyer.

While they Guidelines don't provide for this situation, a common method would be as follows:

Child support for 2 offset against child support for 1
 
Last question :)

My Ex is currently living common law. Due to my financial situation (Just completed Bankruptsy) Can I have the court like at his income for the household?
