Because you have final orders in place and your the custodial parent, I suspect the courts may not consider this a material change for the children as their permanent residence has not changed.


Its more or less an access issue so this is probably why a new application is required with a new file. I believe what they do in Ottawa is the court affixes an "A" designate at the end of your previous case number.

For some reason court's don't see a child's access issue as an emergency or urgent basis and most have to go through the long winded process of regular case management. You might not get the relief your seeking this year but follow through with the action so everything is put in place for next year. Be sure to seek costs on a indemnity basis.
