well some background. My mom has been with this guy for about 5 years, she owns a trailer he is in the process (apparently) of selling his house. He has basically taken over my moms mobile home as he sleeps in the living room and stays up all night and sleeps all day for the most part. He is on disability for a "bad back" but he has no problems working under the table doing work on a farm. He has now stolen an antique washboard from my mother and she is just waiting for him to get home so she can tell him that he better give it back.

I warned her when this all started to get an agreement in place but he said he would never take anything of hers and she believed him against my better advice. They do not share a sexual relationship but go out as a couple.

Now for my question, she wants to put her mobile home in my name so he cannot try and take it or part of it from her. She has owned it for about 15 years. There is no money owing on the home and she is on leased land. Basically it would be in my name but she has to pay all the stuff she pays now. It would be mine just in name. is there a form that should be done for this? We want to keep costs down so I was just wondering if we wrote up a bill of sale with the particulars of the agreement and get it witnessed by someone if that would be good enough. Could he actually have a claim for part of the trailer??

Common law relationships are not like legal marriage, and given that you mentioned they do NOT reside as such, then once he left or was forced to leave he would have no claim on the mobile home. Even if they were living full common law in every sense the same is true.

However, if you want to be safe, why not go to the ministry, and have your name added.

Is the mobile home considered as any other mobile trailer? If so, this is of no cost when the people are family or a married couple. Your mom would simply sign the back of the ownership and a new ownership would be provided with both names as owners.

Similarly, if it is not covered by the ministry of transportation and mom owns the home (with or without a mortgage loan), you can also go and have your name added and for a processing fee, but nothing significant. I had my name added to our home as we have lived common law for 10+ years and both felt we have equal claim on it. We filed the forms from the town hall and paid the fee. Even though he is primary on the loan, we now both are considered owners on record. Once/if the mobile home is clear of any loans, then you can repeat the above but remove moms name at the same processing fee, and because you are family then she lists the sale as "family owned property" and as such can transfer to you at a cost of $1.
