I was wondering if anyone knows if there is a time limitation regarding asking for spousal support. When we separated in 2008, the ex was working full time for $15.00/hr plus benefits. He later got fired, did not have another job for over a year and then received a large inheritance from the death of his father. I have paid thousands of dollars of marital debt. He bought a new SUV, cash and has plenty of "extra money".
I have a much larger income, but have solely supported our children (4 at home at the time of separation). Since receiving his inheritance, he has money to spend and I was off work for over 6 mos. due to illness. I asked him to help buy the kids clothes, pay for school expenses, etc... He refuses. I have told him that I will ask the court for child support if he cannot come to some arrangement. I would also ask for education expenses to be addressed.
He will not negotiate. I was only asking for $200/mos and even suggested directly depositing into the children's accounts so they could learn to manage money for clothing and incidentals. The ex has informed me that if I even so much as send him a letter from a lawyer, that he will sue me for large amounts of spousal support. I dread going through a long, expensive and emotionally draining process, but do feel my kids should be entitled to some support from their father. He even told me it is not his responsibility as I make more money. Any thoughts??
