Temporary order order for Joint custody - possible ?

Good morning community,

I am crafting a Notice of Motion and associated Affidavit based on OCL's recommendations for access.

I was thinking of throwing in the following requests for relief:

1. Joint Custody ( not recommended by OCL)
2. Sale of Marital home. Its now abandoned and burning a hole in everyone's finances.
3. STBX's pleadings be stricken from the record. STBX is in longstanding contempt of order regarding disclosure.

Point 1 is the one I am not so sure about. Can I ask for joint custody in a temporary order. OCL's position is sole custody to mother.

You can ask for whatever you want. Do you know why OCL is not recommending you to have joint custody? For instance, can you overcome the issue(s) which would make joint custody be reconsidered/more viable option?

I believe its due to the high conflict nature of the divorce. I believe a parallel parenting regime with me responsible for education and extracurricular would be workable and is most definitely in the best interests of the children.
 
We've seen how ridiculous and biased this OCL organization can be with another poster (LF32).

My opinion of this OCL is extremely low and I therefore wish you the best of luck in getting your life back to "normal." Fortunately it seems (from reading posts on this forum) that there are more and more judges who are getting fed up with the unprofessional, disastrous recommendations coming from this "children's lawyer's" group. If you can afford it I would recommend doing whatever you can do (possibly by way of hiring private professional qualified assessors) to ensure your children can keep their father in their lives.

I agree with the other posters. OCL turned my life upside down, screwed me so bad I had supervised visits with my son for 9 months, even though I looked after my son from birth. The judge in his order specifically said he is only ordering this because of the the OCL. They are very powerful, beware, a lot of Judges simply go with their recommendations. You must have a good lawyer and very good reasons for opposing OCL recommendations.

AN, that is horrible. I too when through supervised visits, regardless of having taken care of all 4 children from birth. My situation is likely different because of a DV incident. So I accept what happened.

The OCL has (according to my lawyer - on limited retainer - I self rep) provided me with a reasonable access schedule. Its the custody I am contesting. I don't know if I should attempt in a temporary order to try to get joint custody. Frankly it provides no "relief" as is the purpose of a temporary order.

Actually, now that I think of it, it would still be in the best interests of the children, but it strikes me that this would have to be proven in court.
