Support Arrears, Texting Ex

Have an established court order. Now behind in payments for three months.
Fro has garnishing order in place. His work is not sending it in apparently.
He tells me he's paying it. My worker says she has called his work twice and has sent a notice stating he has to pay and he's over due. FRO won't really tell me much, which I understand. It is not uncommon that his work for some reason, regardless of the company he is with, somehow does not send in payments. I have expressed to him that "IF" he has paid, Im not receiving it. I have told him that he may hate paying me, but perhaps if he has paid, he should find out from his employer why the funds are not being sent to me (If in fact they are "in the mail."
Being 3 months behind is causing me a great deal of financial hardship. I am working part time, and am in school, so I do rely on this to help me. He knows that, but ignore me. I text him almost every day with "Still Nothing." or "Please find out what is going on." but I get nothing from him at all..just ignore me.
I do not have a lawyer. He does. I represent myself. He's invested in a HUGE legal firm to fight me for termination of spousal support, and reduction in child support.I am getting harassing calls from bill collectors now..so due to the reason I am late is because he has not paid, I text him. Can I get harassment charges for texting what I have? I feel I have not threatened him, so its just "FYI."…just want to know if I am within my rights to ask where it is after three months? Thanks.:confused:
 
You should be focusing your harassment towards FRO and not your ex. It is the responsibility of FRO to enforce the court order - not you.

Keep in mind that maintenance enforcement agencies are essentially large call centres. In Alberta MEP does not have "file ownership" and you therefore do not have a designated person to handle one's file. IF you are in Ontario you are fortunate. With no file ownership there is no accountability. You have the name of your worker - make them accountable.

And yes, your ex doesn't have to respond to you.
 
If this is a new court order it can take between 60-90 days to receive your first payment. It did in my case. Regardless, as Arabian stated above you should keep calling FRO -maybe once a week to ask about your personal file.

The bureaucratic system is slow as molasses, though once things are set up, you should be getting your maintenance on a regular basis unless Ex loses his job, gets sick or drops dead....
 
Its not a new order.
My worker has sent his work another letter.
Two weeks ago his workplace told FRO that the money was on its way. I have still not got anything. I have had an excellent FRO experience from the very beginning. I suppose I was hoping that if he could tell his workplace that the money is not being sent, it may help. He just ignores me.
I've been told not to rely on the money also.
It's just frustrating. If I did not rely on it, I would not deserve to have it. Thank you for your responses…looks like I have to shut up and wait.
 
Honestly if he is being deducted at the source (his pay check) he has done his part and paid. You need to be harassing FRO and they need to be harassing his employer. I would ignore you too if you text me every day with the same stuff. It's our of his hands... he can't do much more.
