STBX lawyer not allowing late service - can I still file Affidavit

Hi Community,

STBX's counsel is not responding to my request to allow late service of an affidavit for a motion going back to court this week.

I have enough time to file with the courts but not to serve.

Can I still file it to get it infront of the Judge ? should I just walk it in ?
 
Just serve it on them, via fax or baliff.... they don't decide to "allow" late service....

Then present it in front of the judge and if anything explain why you couldnt serve it earlier.

I don't think judges are that strict on these types of rules as long as you are proportionate and respect the principles....
 
Same thing happened to me. I went in for a 14B procedural motion (very easy to do) and obtained an endorsement accepting late filing. Didn't look good on OP.
