Hey all:

Negotiating SS with the ex right now and the numbers my legal advisor is giving me are way off from the ex's. Complicating factor is that I am the sole shareholder of a Ontario Corporation (numbered company). The exes' lawyer seems to think that the retained earnings of the corporation should be factored into the calcuations for SS. There is not a whole lot of $$ sitting in retained earnings (essentially a rainy day fund), so does this make any sense whatsoever?

Thanks

Retained earnings in a corporation are a barometer of the value of the shares. Essentially they represent the equity of the company (assets less liabilties).

The value (retained earnings approximately) of the coroporation has the potential be inlcuded in net family property for the purposes of an equalization payment, but I fail to see how they might impact the quantum of spousal support.
