well was in court today and like i suspected my ex is liaible for not ensuring our learning disabled child applied for all grants and bursaries he was entitled to. she was quite annoyed that my ex didnt' come to court today she told his lawyer she had very specific questions for him that will now have to wait until the settlement conference. The fact that he never answered any of my emails when i was asking for status of the applications and if they had even applied is another factor that didnt help his cause. In addition that now he is refusing to provide me academic information ref my son didnt help either. she pointed out that there is case law out there where a parent that was exempted to pay because the custodial parent and the child refused to provide that parent with schooling information.
when she questioned the lawyer ref why these grants and bursaries weren't applied for he said that Logan is an adult child and is responsible for doing this. Then he also said that Logan is a child with LD's and ADHD and gets easily stressed about school and life so its hard for him to which she answered the father should have been proacticve and helped him apply he should have parented like a custodial parent should.
the one thing that i was a little upset about today is the RESP that i started for my kids to count as my contribution to their education she says its their money so it comes off as their contribution to their education. that i'm having a hard time wrapping my head around that because my ex that never invested one penny now gets to benefit from the money i invested and he makes double what i make.
the judge did say that iwth my income and my ex's income combined that the child is expected to contribute his share to his education that the parents aren't responsible for the whole thing on their own. So that i am quite happy with.
