Thanks! Big kudos to this site, I certainly learned a lot here. Also, If not for this site I never would have known about canlii which is an invaluable resource. After reading hundreds upon hundreds of cases and settling on a select half-dozen I felt quite confident being self-rep'd (although my case is simpler than most).

I'm glad we settled the 50/50 request in a positive way. My ex wanted a straight 7/7 week on/off rotation and wouldn't back down on it. I had made an offer to settle with a 58%/42% split that worked with our schedules but he wouldn't bite. Finally when the child psychologist came on board he sided with both of us saying that 50/50 would be great but not a week on/off as it would be too detrimental to the children's half sister. The psychologist suggested a week on/off where our children would return 1 night midweek during the other parent's access time effectively giving us 50/50 and minimizing the time the children are separated from their young half-sister. I hadn't even thought of that! The ex didn't want to do it at first but his lawyer essentially told him it's that or the current access will remain since he really didn't much of a variation case. So he agreed and the matter is settled.

Now to get the decision. After almost 3 years it will be nice! Supposedly our judge is very thorough and doesn't delay her decisions.

My only concern is how well we can co-parent. The children's father is not easy to get along with but I hope once the order comes out he'll smarten up and calm down. He got the 50/50 he wanted, and all I'm looking for is a fair income attributed to him. *fingers crossed*
 
Hi Linear, good luck with the final stage of your case.

Can I ask how you got a child psychologist involved? My husband would like to do this as well, but unsure of first steps.

I haven't had a whole lot of luck with canlii searches yet, can I ask what terms you searched on for your research?

The psychologist became involved as a result of a "Voice of The Child" request from a previous hearing. He was very nice and it was not stressful on our children.

Today I filed a new Motion that he pay the current arrears and continue to pay CS and S7 expenses as per the current order until the new order is made. His lawyer has been notified and now it's a waiting game.
 
Hi Linear: was it a Form 15 Motion you filed? If so - was it fairly straightforward? I need to go to the Court and look into filing one. The forms I printed off seemed a little complicated. Was yours a Form 15, and if so, what documentation did you attach? Thanks and good luck.
 
I filed a 37A here in New Brunswick, it's basically a Notice of Motion for a family law matter where you're not seeking a variation. Took 5 minutes to fill out. My Affidavit took a mere 15 minutes to write up - nice and quick! The Affidavit essentially stated "Here's the current order, here's what he should be paying, he hasn't paid anything for the past 6 weeks, he won't discuss it, make him pay for his kids, and here's this month's daycare bill"

I've filed 2 previous motions in this matter, both were processed and returned to me within 3 weeks. Hard to say how long until you get your hearing.
 
WOW - Received an envelope from the Courts today, thought it was the decision/ new order. Nope, it was the Motion I filed 6 days ago, I can't believe it's been processed and returned already. That was fast!
