Section 7 and public school additional expenses

Hi all

I'm the only parent who has an income from work so pay money to the other parent each month as CS. Our child attends public school. There has recently been an additional, one time school expense in the $50-100.00 range.

Is this a section seven expense or is it to come from CS?

Thanks

Given that works out to between $4 to $8 a month over the course of the year there is nothing special or extraordinary about this expense and so it would be covered by CS.

I think it depends on income and CS levels. If mom is on welfare and your child support is taken directly out of her check, then an $80 expense would be a lot. If you're paying hundreds of dollars of child support a month then it might not be so bad. I think you need to clarify how much child support a month you're paying before you can determine whether it's an extraordinary expense.

In my order, any school expense over $50 is shared, so a one-time fee like that would be considered extraordinary but $5 pizza lunches would not, even though they work out to the same over the year. Not really logical - but I don't think there's a hard and fast rule for these small expenses.

An $80 one time expense only amounts to just under $7 per month over the course of the year and isn't extraordinary.

I think it also depends on the schedule, if it's 50-50 it makes complete sense.

More info on the specifics of the situation would be required to get a better sense of what's extraordinary as well as the necessity of the expense.

The OP has noted it is a school expense -and an expense for education (primary, secondary, or otherwise) can make it extraordinary. S&T would seem to be correct in her assessment. As she noted, certain other criteria needs to be met to qualify, but it would appear the first one has been.

The Quebec rules are so much better, in Quebec it says if the expense is special due to the SPECIFIC circumstances of your child, its a a much more black and white thing...
