Hello,

I opened an RESP for my children years ago. It is in my name with my children as beneficiaries. My ex pays child support. There is nothing in our court order about RESP/post secondary. I contributed into RESP on my own.

Now it is time to withdraw those funds. My ex is saying that child support paid the RESP. I thought child support was for food, clothing and shelter basically. Is the RESP money considered half his?

I have told him how much I will contribute to their education taking ito consideration the RESP is 100% my contribution.

How does it work?

If you opened it and you contributed to it then it is solely yours to use. He also does not get to dictate what child support goes to pay. You chose to save for the kids education and made financial sacrifices as a result.

Your answer to him is “I contributed solely to the RESP with my funds and as a result, it is mine to use for the children’s education”. And then you put him on ignore.

An alternative would be to take a portion of the funds split each year of school and then calculate the split after that but you may not have the funds to do so.

He can’t prove you used cs nor can he prove you didn’t use your own money.
 
Also, not sure how he found out about the RESP but that’s moot.

You don’t need to tell him what your contribution is. He just needs to know full costs and the child’s portion. It is split as:

Full costs less any grants or bursaries. One third is allocated to the child. The remaining two thirds is split proportionate to income (section 7 split).
