Questions Regarding FRO Enforcement

Hi,

I'm having issues with the FRO with enforcement of S.7. Expenses.

I (father) have joint custody / joint time sharing for my 22 year old, who is attending university out of town. He is completing his 4 year and expected to graduate in April 2026. Hi is in Coop and hasn't returned outside of short visits between coop placements.

I had to take my ex to court as she was unwilling to adjust child support or pay/contribute for any section 7 expenses whatsoever. This resulted in my paying big offset CS (she doesn't work) when CS wasn't owed and paying 100% of the post-secondary costs for over 2.5 years until the mater was resolved. This has largely been corrected, and the court action resulted in 3 Support Deduction Orders (SDOs).

  1. SDO 1. Father to pay CS when child was not in school (as defined by mother) as well as S7
  2. SDO 2. Mother to pay S7 expenses to father
  3. SDO 3. Mother to pay Costs
The FRO has sent me a letter last week stating the my FRO Case is closed because the Costs order has been fulfilled and there is no amount owning, and that they will NOT enforce Section 7 expenses for me (SDO2), as there is no monthly child support owed by the mother. Basically saying that SDO 3 is done (no issues here), but also SDO2 is non-enforceable. While they keep SDO active for mother for both CS and S7 expenses.

Can this be true, is this accurate? The agent is spoke with at the FRO insisted that I had to go back to court (what is the point if they won't enforce)

P.S. Mom really takes issue with reimbursing my expenses and would rather pay the child (ironic since she collects child support directly). To reduce conflict, she pays the child her portion of the expenses and I do the same. She's stated that she will no longer support the child, but this gives me no remedy if FRO won't enforce and I'll either have to watch my son drop out of university or repeat this exercise. The judge was not very sympathetic to the situation and took no issues with Mom's refusal to pay expenses until the eve of the court date 2+ years after the child started university.
 
If your order states amounts FRO will enforce it. If it doesn’t you need to go back and get an amount to be recovered.
 
I guess my issue is that they are enforcing S7 for Mom, but not me despite having a reciprocal order requiring them to (although I do not have CS owing, they are only stating offset). I'm supposed to be able to submit these costs and have them recovered for items like Tuition, textbooks, rent, etc...

They won’t do it if it is “interpreted”. They only do it if it’s an amount.
