Private Member’s Bill C-422 - Equal parenting (Mr. Velacott)

I have contacted all the parties in my riding of Barrie, the only one with an actual plan for equal parenting is the Green party. The NDP responded saying they would look into it for me, the conservatives tried to beat around the bush and the Green Party responded citing where in their policy it discussed shared parenting, they were also the only party in Barrie at the Rally against Parental Alienation. In the last vote they actually got more votes than the NDP. So I know where my vote will be.
 
Unfortunately, Bill C-422 died with parliaments last session and ANY forthcoming elected member may initialize it's revival under a new private member's bill. Sadly, To date, Mr. Vellocott is quiet regarding a revival initiative. Maurice Vellacott, MP
 
Well even though Hamilton does not have a Green party this year, I will vote for them in Barrie. You could always spoil your ballot Working Dad to protest

I would like to point out that this article is more than 2 years old and there isn't a single sourced statement showing that Layton is against this. They are basically saying that they "heard" he wouldn't support it.

I have no clue whether or not he's for or against it, but let's at least have something more concrete than a few guys climbing onto a roof and then making wild speculations.
 
There's just no valid argument to the contrary...
Custody should and MUST be 50 / 50 unless there is extenuating circumstances to the contrary...
Any other position confers a distinct advantage to one party...and has resulted in dads usually starting at the bottom of the hill.

I want to assure you that I will keep your experience under consideration as the opportunity arises to make the changes necessary to provide a more equitable system in Canada for divorced spouses. In this regard, I would like to direct you to my colleague, MP Maurice Vellacott, who introduced Bill C-422 in the previous Parliament. Bill C-422 would have amended the Divorce Act to replace the concept of “custody orders” with that of “parenting orders”. It would have instructed judges, when making a parenting order, to apply the principle of equal parenting unless if it is established that the best interests of the child would be substantially enhanced by allocating parental responsibility other than equally.

While Bill C-422 did not pass the previous Parliament, I am confident that MP Vellacott will be reintroducing this legislation. Dear Mr. Vellacott,

I am forwarding you the response that I received from MP Joy Smith who pinpoints you as the Member of Parliament who has put on his agenda the vital need to amend the current Family and Divorce Laws in Canada. It is very much my hope that you continue this quest as I am aware of many cases of gross injustice through the current Legal System. I wrote to you my personal story on the 20th July (see below for easy reference) and I am in contact with many others who's stories are not far different. The time for change can not come soon enough for the current families trapped in a system that sets to destroy families with even farther reaching consequences of children who too often grow up with lifelong afflictions or delinquencies as a result of the current practices.

It is my belief that the following amendments need to be addressed as soon as possible so that Canada can preserve its health, integrity, and justice for all.

1. Automatic joint shared custody. With the onus on the the claimant to prove just cause to strip parental rights off of the other parent. I believe this is your plan with Bill C-422.

2. An overhaul of the Federal Guidelines so that people are not left in a substandard standard of living after Spousal Support/ Child Support/and or Section 7 awards have been paid out. This means they need to take into consideration monies actually taken home - not grossed up figures, differing tax brackets, tax benefits and awards given to the recipient, cost of living, percentage of access, etc.

The Federal Guidelines are far too simplistic to deal with individual cases in a fair or equalized manner.

3. Immediate removal from court any cases that have highlighted Child Alienation into a private Arbitration setting wherein there can be swift resolve as these cases prolong abuse on children.

4. Immediate end to treating dads like criminals stripping them of licences or jail time. For these extreme cases - financial counselling or help should be offered to assist those behind in creating reasonable means of payment plans. Preventing men from either getting to work or being able to work at all seems to be the most ludicrous way of obtaining more financial support for their children. It strips his ability to earn and costs the tax payer more. Many men are not dead beats they just have been shafted so bad they are in a downward spiral that is quite simply impossible to get out of. Let's not have yet another suicide - robbing children of their fathers.

5. Accountability for those that break court orders. I'm all for volunteer hours when people breech contracts. Least it is more productive than other slaps on wrists. You didn't let daddy see his kids = 25 community hours at a homework club for disadvantaged children. You didn't pay your portion of section 7 - payment plus fine plus 25 hours teacher soccer at Tim Hortons camp. You didn't submit your paper work - Pick up garbage on the side of the Hwy. At present people can behave as badly as they want and fail to follow Court Orders with next to no consequences.

6. Having people abuse the court systems time and time again in vindictive and power plays benifits NO one. Repetitive motion makers need to cover the entire cost of the proceedings to discourage this vindictive behaviour.

You won't see it in front of parliament until at least the end of this year, but most likely not until sometime in 2013. I spoke with my MP's office and they explained that there is a schedule where MP's can't bring forward a PMB until their 'number is up'.

Vellocett is planning on reintroducing the bill when he can (again from what my MP's office was able to tell me), but they are making some changes from the one that was before the last session of parliament.

I wish I had more information.

To get politicians to listen (ie take you seriously) you need to make your issue an election issue. If a Bill of this nature is something you want contact your MP's office and let them know.
 
I went through the case conference just this past week, thinking that aside from wild/ inaccurate not to mention false allegations of violence and abuse , any sane person would grant 50/50. alas the Judges opinion was that as the parents weren't communicating (no SH!T, we're getting divorced) that the kids are better off with their mother.

Maurice Vellacott has recently called for a law to protect the unborn from bullying. He is obviously not putting any effort into his shared parenting bill.

The censorship on this blog about the issue of equal parenting is truly becoming ingenious! My threads about the powerful feminist lobby's suppression of equal parenting have been hidden so others on the forum can't see them, but the threads show up for me so I think they're still there. Big sister is getting powerful!

Why all the censorship? In my last thread "Why Shared Parenting hasn't Happened in Canada" I mentioned Barbara Kay who at 43:14 of her video "From Women's Rights to Feminist Wrongs: Society's Contemporary Contempt for Men" quoted Erin Pizzey, the courageous founder of the women's shelter movement who was "disappeared" from the movement by feminists when she dared to speak the truth about spousal violence being bilateral:

Kay quoted Pizzey as having said that as far as gender politics go:
Canada is the scariest country on the planet, scary to men who suffer because of it certainly but apparently not to most other Canadians who remain curiously indifferent to the demonstrable misandry, the dislike of men, that permeates institutions that define and shape our culture.​

We know Canadians are proud to live in one of the greatest countries on earth. The problem is this smugness leads to the Canadian indifference Pizzey mentions above, making us unwilling to discuss uncomfortable truths like the stranglehold feminism has on the family courts. And it's only in the face of this indifference the truly unconscionable suffering those courts routinely inflict on children and men can happen.
Polls show over and over again that the majority of Canadian's favor shared parenting.Studies commissioned by the Canadian government since 1998 have recommended shared parenting for well over a decade. Shared parenting advocate groups have presented incontrovertible data that children have better outcomes in every way under shared parenting. So why doesn't it happen?

Feminism has gotten a stranglehold on the popular media.

We are committed to feminist control of that entire process.

Feminist misinformation can't be countered because there is no public forum in which that is permitted, except from another woman (like Barbara Kay). Men who voice such opinions are generally shouted down as "woman haters" without anyone even taking note of what point they made. Few men except those like Michael Coren who makes a living from pissing people off, can risk their careers and livelihoods to speak out.

We even see that control in this forum. I was surprised to find the entire thread about censorship in this forum deleted minutes after I posted it. In it I had merely posed the question "has equal parenting legislation failed because we as Canadians are resistant to publicly discussing the difficult issue that Canada is simply too feminist for it to ever pass?"

The point is an aggressive one. But I didn't make it without thoughtful consideration. In fact in the thread I had quoted two extremely knowledgeable and well respected legal experts who also spoke of the deeply rooted problem of gender bias and feminism in the family courts.

Lawyer Gene Colman who defined Gender Bias as:
“the tendency to interpret the actual facts of the case before the court through a judicial prism of favoritism to one gender over the other where such favoritism is based on prejudice, stereotyping, distortion and irrational preference. What passes for common sense one day or what passes as a scientific research finding the next, may show, on more rigorous examination, to be nothing more than expressions of gender stereotyping, prejudice and bias.”​
and Edward Greenspan who said:
It is clear that the feminist influence has amounted to intimidation, posing a potential danger to the independence of the judiciary Feminists have entrenched their ideology in the Supreme Court of Canada and have put all contrary views beyond the pale.”​
Not only was this entire thread deleted but the last 5 threads I've contributed to have all been locked to prevent me from even politely expressing my opinion. A disturbing trend has appeared.

Men on this forum are consistently censored when they express opinions that might be critical of feminism:

It is time for change and it is tiem to rally the troops. Most people support the idea of equality. Write your local MP, even better pay him a visit. I started talking to local politicians. I have written the Minsister of Justice and Attorney General. Start knocking on doors and waking people up.
 
I would love to hear more about Bill C-422 being re-introduced in 2013. I was informed by my local MP that the Bill was dropped? Is there a link to the full content of the Bill? I certainly believe that change is required through my own personal experiences, but I need to believe in the Bills entire content to support it.
