paying the ex’s mortgage

I have been paying the ex’s mortgage for 3years in hopes of keeping the matrimonial home. It has been a long and it looks like it will not end for sometime. Another situation has now come to light and I’m planning on not keeping the home.
1- Once she finds out that I’m not paying her mortgage. How long could I stay in the house before I’m forced to leave?
2- I’m receiving SS. Can she stop paying me the SS if I do this?

Was there an agreement for the house. If you are staying in the house and was paying the mortgage you cannot suddenly stop prior warning your ex. Who is paying the taxes and insurance?

First if you do not tell him, it may go in collection before he realise that you are not paying. This is not the proper way to do it.

If you both do not want the house, the best thing would be to put it for sale.

Face it, you may have to pay rent.
 
I’m still living in the home and the SS is not court ordered. A month before I was to go to court, my lawyer suggested an amount. That we both agreed to the amount. This was till we finally have a legal separation or divorce order. This was close to 1.5 years ago. With my cpp, the SS and with help from friend, family(s) I was able to maintain the house expenses and a basic life stile.

There was no formal agreement as for me staying in the house. The ex moved out 5years ago and couple of weeks after I relieved a letter till me that she moved out and that she stopped paying the mortgage (taxes in) and the house insurance, the month before.

I have always planed on living in this house. In her letter, “if I was going to live here then I will have to pay her mortgage and our house insurance”. (The property is in her name for the last 15 out of 33 years.) I used my savings for the first 3 years. When that was gone, this is when I stared looking for SS. (I’m not in the best of health. I’ve been in and out of the hospital the past 6.5 years). I have tried going back to work but it did not work out.

There is not much left on the mortgage. It is been renewed every 6 month for the past 2 years. As it goes down the cost is going higher (she is not trying to find good % rate.) With the changes to hydro, taxes, the higher mortgage payments and basic living, the monthly expenses are up 30 / 40 % depending on the month. This is also part of my realization on how things are looking.

I had an eye-opener this week and I can see now that our family matters is going to take a long time before it comes to an end. Life after marriage should not be like this, no matter who it touches. Looking at my age and health it is best that I plan for a different life than here at the matrimonial home. I’m going to ask my lawyer to make an offer to settle with some concision from me. I’m going to ask for a 30 day reply. If we could end this way and with an equalization that’s close to what I’m told it will be, I could then live here. If not then I would like to stop paying the mortgage and insurance and offer to pay the going rent in this area till this is over. If not then I move on, (soon.)

1-So how long could I stay before I’m told to move on?
2- Can I leave my half of the household stuff if and when I go? She did when she left.

We both wanted the house 5 years ago. I still do but not at this expense. I'm not sure about her! The house is in her name I do not think she would sell it!!!!???
I had a real estate agent come in to give me an idea at what it would sell for today. He thinks it would be 15 to 20% lower than what it's appraised value was when this all started.
