Now I know why she wants sole custody

I was misreading one of these calculated support forms and I realized that if my ex get sole custody she will be getting about 38k Net/year while having no job.

The form has something like
Child Support Received: +12000
Child Costs: -12000

And then later on in the spousal support section it shows my net income at 25k and hers at 28k, completely ignoring the fact she is getting 12k in CS payments.

She really can just stay home while I work... wow
 
The worst part she probably getting closer to 50k right now in support payments etc... until I get to court.
 
It also seems like the family tax benefits is just completely ignored too.... to her benefit

Links17, I have a bad news for you: yes, she can stay home while you work and it likely stays like this even if you go to court. Sit in just a day of motions and you will realize this as 90% of the cases people are there for exactly this. The judge is not even going to blink an eye when he/she orders exactly what is in that support calculation.
 
Quebec the sessions are "in camera" only lawyers and articling students can sit in....

I hope with my psychosocial report supporting shared custody and the fact the kids are both in school full time and she is early 30s, uni graduate and bilingual changes things.
 
If you can get shared custody with 50% access that's the only thing which can change things. Nothing else matters. At least not her age, education or spoken languages.
 
Should be in the bag.... but now I realize why she has been fighting it tooth and nail. Its the difference between 24k and 38k for her.

Exactly. The same with joint custody...unless you make sure your access to your children is split evenly 50/50. It must be at least 40% in your favour, but you should aim for 50/50.

As mentioned many times...custody and access are two different things.
