Not paying me said under oath

not recieving child support or spousal. In argument with my lawyer, he told my lawyer under oath that "she's not responsible enough to handle cash, so he wasn;t paying me.

What an idiot.
What does a judge do when the spouse does that? He did give me a hundred here two hundred there, but the court order is for almost four thousand a month. Now he has asked for lay off from work. I can't prove that.
He is staying at his parents, and not paying anything. He cut back on work because he is not wanting to see his paycheque deducted. FRO is taking his money now, and he is thinking, "I'mnot working out here to give her money"
As well, he won't show he made a lot of money, because he didn't go to the union hall to put himself on a list. ALl that to reduce his income.
Am I screwed?

 
if it is a court order you are not screwed. Eventually he will have to pay what he owes especially the CS. It is just getting the money from him that will be hard.

Did he say what he said in front of more witnesses then just your lawyer?? If he said it in front of a judge then he is the one who is screwed.

I am not sure what type of job he has but signing a list at a union hall does not have anything to do with showing income. If he belongs to a journeyperson type of union (drywaller etc) then he can be put on a list there for work.

Unless you can prove that he is intentionally asking to be laid off then there is no reason to bring that up in front of a judge. Judges like proof. As for him living with his parents and not paying them anything be careful wth that one also. If he is smart enough he could be giving them money as "rent" just to have them hold it for him until later. That way he could show it is coming out of his account and into theirs.

I really hope that you can get the CS worked out for the child(ren). As for the SS I am not a fan of that and how it has become a tool for some (not saying all or you) woman to stick it to the ex for a long time to make him "pay" for the marriage ending.
 
Yes, he did say it in front of my lawyer, his lawyer, and their was a steno lady taking down the discussion. My lawyer submitted it to court.
 
If CS payments are going through FRO then it's their responsibility to act on your behalf. It also forms a record of his payments (or lack thereof) and if he isn't paying the Court ordered amount then FRO has the right to go after him for what he owes. They can:

1) garnish his wages
2) take away his driver's license
3) take away his passport
