Without going into details I am looking for someone who legaly dealt with their landlord or has knowledge to talk to. I am launching a lawsuit vs my current landlord. I am not after their money but gotta teach them a lesson and get my money back.
 
My landlord bought the 4-plex I lived in. He then increased my rent by 80%. I took him to the rental tribunal and won. I got my money back, but in the process he served me notice and I had to move. We went to court, but I lost because he said he needed the apartment for himself.
 
Which province are you located in, again? If you have a legitimate issue/complaint with a landlord, in Ontario, the Ontario rental housing tribunal is your best bet.

Always deal with a landlord in writing, for requests/issues, etc.

If your claim is for less than $5k you might be better served going the small claims court route.

My experience is that the LTB will do everything in their power to satisfy the tenant and stick it to the landlord.

Much depends on who your landlord is.

I have been a tennant and I have been a landlord.

I've been the vice president of the largest tennants' association in the country.

We took the landlord to court for deliberately under heating the buildings. It cost us hundreds of thousands of dollars, it cost them a little more after the judgement. The problem lessened but didn't go away until the building was sold.

You can't teach landlords a lesson if there is an economic advantage to them to continue bad behaviour. How much are you willing to spend to make a point?
 
In my case I was not going after the landlord's money. I was trying to get mine back, and did. It was all done through the tribunal. Neither of us needed a lawyer. There was no "lawsuit".

iceberg... can you give simplified details?
 
This place has sewage gas leak and horrible odor from shower drains. Accordind to the city drainage team, it has risk of explosion and 40-60% of sewer odor (which contains methane and hydrogen sulphide) is spreading through the whole house. If I shut the heat down and use heaters it still stinks.

Also the plumbing system is connectel illegaly and the city told the landlord it is now registered in the system that landlord has been warned/notified.

I told him to give me my money back and and fix the vents and eliminate the contract but he wont. Health enviroment is after them but so far nothing is happening.

I want him to fix while im here (the sewer gas) because next tenants could get serious health effects or even die from this (possible explosion or methane/sulfide)

The gas leak is right next to boiler light pilot. So yes I will get my money back and teach him a lesson that health and safety of people comes before money

After he fixes the sewer gas leak then the next tenant will only have to deal with drain odor (not sewage) but at least they wont be exposed to risk of explosion or serious health hazards. (Not sure if drainage odor contains bacterias but health department is not concerned about that one, he did clean the drains but smell returned)

Firhill- It is under 5K , I used worl lawsuit ( english barrier) but it will be some kinda court I have free meeting with lawyer, It could be over 5K depends how long I stay in hotel.

Paris, Tenant-landlord board gave me this lawyers number and said to take it from there.

I wont claim psychological and phycical suffering unless lawyer advices otherwise. 4 days I was literally freezing and inhaling shit odor
 
I don't know why they referred you to a lawyer. You can start action with the Tribunal yourself. You can file the forms stating that the landlord has not kept up repairs in the unit. You can also request to pay your rent directly to the Tribunal Board. Once the board determines how much rent return you should get (because of the issues) they will compensate you, and give the landlord his rent money.

Having him wait for Tribunal decision to get his money is one way of teaching him a lesson.

I never heard word tribunal regarding this matter. Maybe rules are different in ON. Maybe this lawyer will suggest something else, some other way to deal with it. But landlord-tenant board act said they only give suggestions and after attempt to resolve it failed they said talk to lawyer. This lawyer only gives advice.

We will see what he or she says. And landlord is not getting any more money Im looking for a new place. I need to break the lease though
 
Hi Iceberg.

The Fire Chief has authority to order landlord to fix or vacate. I had to make a complaint last year and they acted on it quickly particularly if a tenant contacts them.

If you go this route be prepared to have to move out immediately if the problem is as bad as you say it is.
