Didnt that feel odd adn made no sense?

Absolutely ! But my ex is very high conflict...when he made our kids strip down to their underwear only in my front door so he could take their clothes enough was enough. I don't care where the clothes go that I buy (I am not buying them for me...they are for the kids...). I don't care if they wear them during his week or mine...but HE does care and uses it as just another situation to try and control/fight about.

So...The next time I sent them back after the above, I had his clothes in a bag and sent them in mine. He sends them back in the exact clothes, and he has not embarrassed our children by making them change in front of us again ! That is more important to me... I am giving him less opportunity to fight about something stupid. (Seriously...one time he sent our youngest to me in an old ripped t-shirt...I sent him back in a brand new hockey jersey and my ex lost it ! I don't understand and I'm not going to try). This is where I made a simple change on my end and it works and causes less conflict.

I also wait 24 hours to respond if it's stupid/argumentative...it works !
 
It works for her because you allow yourself to be engaged in her conflict. The more conflict there is the more it will effect custody. If she can prove that the two of you cannot communicate then the chances of having shared custody diminish.

Don't they implement parallel parenting in HC cases? In fact that is what I may ask for. We have status quo of 4 years, how likely is that to be diminished since the child is bonded with both parents and is not directly exposed to conflict (not when with me anyway)? Now I am not saying the judge can't/wont do it but is not it unlikely?

Instead, you need to be able to show that despite the numerous texts/emails etc attempting to start conflict, YOU did not respond and made every attempt to ensure positive communication.

She's baiting you and you're playing the game. It has ZERO to do with gender and EVERYTHING to do with how YOU are handling your side of things.

Let her act batshit crazy. Sit back and watch. But DO NOT respond or get drawn in. It's very simple.

The clothes thing is nothing comparing to what our real conflict it. Here are some examples, but keep in mind she won't write the BIG stuff, she would say it verbally.

Threatening of taking full custody. Once I asked her when I was visiting the sick child during her time under what grounds can she take the child. She said "because we no longer feel safe with you". I couldn't help but laugh....I recorded. After she calmed down she said "Don't let this escalate into court because you know where you are standing". Thats all she said.

Where am I standing? The only conclusion I came up with is that she meant that I take medication for my lifelong anxiety or situational depression.

She sees her self as the better parent. IDC who is better as long as the kid is happy. But if you ask me I see her priority is love life. (can't prove but know it). Them manage some business and having good income is also a card she counts on.

Now here is her provoking in text that I have to reply to. And the reason I say I have to reply is, if I don't, I may look suspicious. Just like Mess said to mamabear4 to her question under Parenting Issues category, what I believe he meant is, if she don't reply her ex has record of emails that her relationship with kid is not good.

But here is what she text me: The child said you told her to hate my bf, she said you fed her junk food, she said you let her play on iphone and I told you not to due to radiation, she told me you teach her to hate her cousin etc etc...IF I don't reply to these I MAY look suspicios but always replied nicely. Then she said don't look for the excuses I believe the child.

Then I told her to call the cas and stop harassing me. That is our conflict mostly about.

And btw, why she wants full custody now. Why she signed Minutes for shared custody. When we separated her family couldn't watch the child and put her in daycare. I took her out because my family can watch them. She was deeply into her bf hunting. The toddler needed extra care comparing to now. She is almost 6 and we no longer fear she will swallow an object or something (even though we still watch for it). Mommy settled with her love life and now finally has time for the child?
 
May May, That is horrible. At least my ex didn't say nothing in front of the kid when I dropped her off but she texted me. Sorry but what your ex did (making the kids changing the clothes at exchange) if close to insanity.

I was going to bag up everything ex bought that is still in my house and give it to her but am worrying it may look as a sign of NON-CO OPERATION
 
Iceberg...I don't think it will make you look non-cooperative... if she is requesting the clothes back and you give them back, that shows cooperation. Then from now on when the child arrives at your house from Mom's, change her into other clothes you have and when it is time for her to return to moms, have her change back into the clothes she came in.
 
Iceberg - I think you're getting all worked up again over an issue that you probably shouldn't even be responding to. Continue to do what you think is in the best interests of your daughter and ignore her baiting. Focus on the future. Are you working these days? If you come across as a bundle of nerves that won't do you any good. Maybe go to your doctor and have your meds adjusted. I'm not intending to be sarcastic here but you do have to calm down a bit and maybe not be so reactive to everything your ex says. Calm being the key word here. Take good care of yourself.

Thanks Arabian but things are under control for now. She cant bait me to the point that I insult her. If she really wants high conflict I cant stop it, she will find ways trust me. I work at WEM after being fired from my job for missing so much work due to kid's sickness but now I make 3x less than I did before but they understand my situation and let me take kid to hosp when I have to. I am calm regarding her texts but honestly I am worried because we are heading to court, that is the only thing that worries me and somewhat scares me.
 
Did you get court date?
Working at WEM during Christmas season sucks - highly stressful (my son worked there several years). Noise level alone would drive me bonkers.

No court date yet. This is the thing. Child went to pre-school here in my area 1/2 day for 4 days a week for 1 year and is going kindergarten here 1/2 day 5 days a week but so far missed most of school due to treatments.

I attempted to make some kind a deal with my ex where the child should go to school grade 1 because it will be full day and the only thing she insists on the child goes to school in her area and is offering me weekends (eventually will file for EOW) and because of the distance we have to go to court to settle this.

I want for shared parenting to continue but will the court allow it? I believe in Alberta driving distance 1 way shouldn't exceed 1 hour so maybe 1 of us can drive the child to/from school during their week? Will one get awarded full custody? she is confident she will.

Very tough and complicated situation
