i'm from ontario and need to get advice on what to put on order that i want the court to make, and also laws and rules on which i am relying... do i need to go to a lawyer to help me with this? (form 14b motion form) and also the next page where it says i am relying on following material: tabs/pages... is this from original divorce form? i filed for divorce, (we only made it one day of marriage, honeymoon was over literally first day). divorce app is still with divorce department. did this in 2005 but spouse reluctant to sign papers and finalize everything. now spouse is not in canada any longer. i'm wanting to marry someone else, and need this done quickly as possible. don't know if this making any sense, but would appreciate a reply from someone, so i know what to start with. thanks!

first off welcome to the site
If I read your post right you have been separated since 2005 after a one day marriage? File for divorce on a years separation (actually over a year) and you should have no problems. Your soon to be ex is no longer living in Canada but I am thinking there are ways around that.

so you are saying that all i have to do is enter that since we have been separated more than one year, this is why i want to open the divorce again? and that's it? also, we married in toronto, and i don't live there now, would i be able to mail the motion in to the family court? i'm really new at divorce as you can tell, so i don't know what the procedures or the costs to diy divorce is.... thanks so much for any help you can give me to speed this process along. (and we have no kids, no properties, no joint anything) also, would i have to put an ad in the paper saying i want to locate my spouse?

I agree with the other posters that your situation should be relatively straight forward to resolving. I would like to adress your question regarding tabs. Think on it this way: Tabs are used as a means to organized and present your evidence to the court. Evidence being say an appraisal on property, Financial statements, OCL CAS reports, anything you wish to bring forward... the items if entered would have to be sworn in by an affidavit & served on the other party as well another copy for the court. from your statement that you have no joint assets (house) or claim for support you would not have to do that.
Having said that if there is anything you wish to present most court clerks are very helpful in helping you sort all this out and making sure you have done what you need to. As many will say here two other great sources of help are FLIC (available at the court house) and Legal Aid. You requests seem pretty straight forward so should in reality just be a matter of filing the paperwork. Also by all means ask any questions that you may have here, there are many that are helpful.
