Hey there, I have a question about the appraisal method.

We had a seperation agreement and my wife and her lawyer somehow came up with a value of the house. I agreed and everything was settled. That was a 1.5 years ago. Now they are seeking the agreement to be set-aside.

As per our sep agreement, I got my own mortgage, and the house was transfered to my name. My father had passed near separation date. I have dumped some of my inheritance into my home... ie, new roof and plywood, massive kitchen upgrade and turned a huge storage room into a rec room.

I wasn't even thinging about keeping receipts, but have found many.

I don't have receipts for the roofer and drywaller as i paid them cash.

1) if we get an appraisal for the sep date (1.5 years ago), is it done by looking at the house condition now and evaluation 1.5 years ago subtract any receipts I have?

OR is it don't by the houses actual condition on Sep Date? I do have before and after pics.

2) I have read that Sweat labor is not considered...... So I just provide receipts for material? The Cash I paid the contractors im sure I can't bring up. So I guess the material put it's self together lol?

Thanks

Tell your ex your not playing her game. A signed agreement is final. End of story. If she insists, remind her that the agreement wasn't just about the house. It invovled all issues. You gave on one issue and gained on another, as did she. Now she wants to reopen one item. No way. She'll need to show why it should be reopened. If she had representation, she won't get a nickel. I'd ignore her request. If she files a motion, it will have to make an argument based on statutes.

Thanks robrjm for your reply. I hear u. Her new lawyer is claiming that there was no financial disclosure. My lawyer and her old one missed that lol The lawyers did up a huge seperation agreement with all our debts and assets and values and we divided everything up. I still even have her lawyers recomendation draft. When I filed 4 divorce we got a swift letter from her lawyer stating that they were making a motion to have the agreement set aside and we need to go to mediation. Since I don't really want to go to court (Costs). I don't mind Dividing everything up again, as we will come to the same conclusion, ... I've done it a million times, but the house is a variable that is un known to me with all the reno's I've done. It seems to be a rare case. :(
