FRO overpayment

Hey everyone,

We're hoping to get some input here.

We received final judgement on October 28, 2011.

We are currently waiting for the court to release a support deduction order to FRO.

My husband is currently being garnished by FRO - 50% of his pay. This is for arrears of section 7 expensese which ended up being dismissed at trial.

The judgement stated that all arears including those within the final judgement be set to $14,000 effective October 1st.

And that we are to begin paying $250 a month towards those arrears as of December 1st.

Since FRO hasn't received the support deduction order yet, we are paying $1500 instead of $250 a month. Our questions: Will we great "credit" for the extra monies being paid.

Any help would be appreciated.
 
Not sure I understand.

Arrears were dismissed ... but then set at 14K?

Wouldn't you be be paying reduced CS (amount?) + 250/mo arrears?
 
Sorry....I know it's all confusing.

While in the process of trial the ex submitted 12,000 of arrears for section 7 expenses to FRO at which point they began garnishing my husband.

The judge ruled that majority of the 12,000 were not elegible. Thr judge did reward arrears of some section 7 and CS which came to 14,000. So, in addition to his monthly support payments he is to pay $250/month towards the 14,000.
