My ex is hiding money is what I believe, she is that sort. We did our financial disclosure in November 2018. We did the final order in November of 2019.
She reported her income as zero and her bank balance in the negative.
Some how she had $500 of income in 2019 and I believe that is the interest from the money she put in a bank account she did not report.
I have a temporary for disclosure she will not follow, this order came up because I was asking for child support to be adjusted.
She never did give the tax slips for 2019 and have lied and lied and lied.
A judge said it wasn't required for child support despite me saying it was money she hid away. Maybe I should have said she was secretly working under the table and her bank balance reflected the income in interest.

How do I get that tax slip so I can move forward knowing she did or did not have that money in her bank account?

The other parent hid money during the divorce. They said they had less than nothing in their savings.
They made $523 that in that first year they claimed to have no income and no savings. Where did they get the money? Savings account interest.

Tax slips should show they had interest from savings that would equate to about $80K.
I thought the courts would take care of this stuff but all someone has to do is lie on their court form and not reveal hidden savings and it is "OK".

So I want those tax slips showing interest. How do I get them?

Was this during equalization? You believe they had savings? You didn't request full disclosure? Did they not provide three years of tax forms as part of the process?

If they provided full disclosure in the divorce period and it didn't come up you will be hard pressed to go back and claim they are lying. What are you going on?

The investment income could have been from an account they opened after the divorce and the money could have come from equalization funds. Or someone could have given it to them or it could have been an inheritance.

The onus is on you to prove they were lying to get the disclosure after the divorce.

My lawyer did the work. They other side fills out the paperwork and submits the accounts, it is an honor system with affidavits and stuff.

They had zero income sources for the year. None.
They had zero money in their bank account
They owed their credit card $15K
Where do you think an income of several hundred dollars in an odd amount such as $456.23 came from?

No. They did not receive enough child support from me to cover their rent.
They did not claim they received a gift.
They did not have credit.
There was no inheritance
As far as I know they didn't rob a bank or run drugs and put that income in the bank.

That is why I am posting. What evidence do I have to provide so show they received interest income from a bank.
I want the tax slips that show where the income came from. If it is from a bank then that is good evidence, how do I get that evidence?

I already have a court order for the Child Support disclosure they wont follow and when I got a temp order the judge said the amount was so small they didn't need to see it.

So......how do I get the tax slips?
 
Did you get their tax form for 2019? What box was it in? There are several boxes it could have been in that would help you understand where the income came from.

If she received investment income, it could be that she had an account in 2018 and emptied it to pay her lawyer (making her statement that she has no savings true) and the income from it was realized in 2019.

You also need to look at the cost of reopening this. If she was hiding money, is it enough to make fighting it worthwhile? Let's say it WAS 80,000. If your legal expenses to reopen and fight this could be 40,000 making it not worth the fight.
 
It was not investment income. She had no savings to generate that money, no job. The only income was child support.

I am asking how do I go about getting that disclosure. I already know the answer "go pay a lawyer" so I am looking for something else.
I have a court order stating disclosure is required for the child support but it wasn't given.

How do I go about getting the disclosure?

You request the required disclosure and if not provided, you file a motion for a new order with consequences. You don't seem like you'll do well alone, so "go pay a lawyer" is pretty accurate.

Show that other parent had undisclosed income OR that they withheld information during original disclosure amounting to a significant amount of money. Life changing money for some.

This is useful information. First time I am hearing it.

This feels like an offensive an aggressive statement, but I don't know.
Why do you think I won't do well alone? Is this a particularly tricky thing to go through the courts?

Well you aren't making much sense in your posts. The only thing you have to go on is that your ex had income of about $500 and you are claiming they had withheld information. You aren't able to share (or don't want to share) where you saw this information and you can't seem to articulate why this information leads you to believe they lied about having money.

From what you have posted it appears you think they were hiding money during your divorce and saw some disclosure that showed they had income after your agreement was signed. You haven't noted what this was or where it was posted which doesn't mean anything.

Only withdrawing money from an investment account results in a tax slip for income. A savings account doesn’t.

How exactly are you going to present this? 'Your honour we signed an agreement in November 2019 and then my ex gave me tax disclosure saying they had an income of $500 in 2019 so I believe they lied on their financial statements in our divorce.' Do you think a judge is going to side with you? Have you spoken with the lawyer who represented you in the matter about this mystery money? Maybe you should start there.

Be aware that if you file a motion for disclosure and you lose, you have to pay the other party's costs so be very sure about your argument and it can't be “they are the lying type”.

The ex has no explanation for the $491.37 or whatever.
I have the assessment so where did the money come from?

I hope a judge would would be curious as well and I don’t see a privacy issue here. Someone else could look at it too. She has avoided aha big professionals assess the assets.

anyways how long do I have to pursue this now that I have an unfulfilled court order? Normally it is 6 years to go after assets.
 
It's less than $500. You signed your agreement in November. She could have earned that money in December. After the agreement is signed what she does to earn money is moot and has nothing to do with your divorce.

If it was listed as employment income then it could have happened after your order was signed or even after the date it was needed. If you were provided that disclosure at any time in 2019 then yes they might have been hiding money. In 2020 it is such a small amount it means nothing.

I didn't get the T4s. I only received the assessment. The assessment shows the dollar amount of income only, no details.
She did not state she was employed. Not a dime of income from employment claimed. Zero, nada. Zilch. She paid no income tax on that money. She avoided contributing to Child Support for years.
The money is not accounted for.
No one pays $431.37 for casual labor; they pay $200, $250 etc.

This is how much $431.37 accounts for when it comes to the places she puts her money.
$437.37 = $172, 548 at those low interest rates of 2019 of .25% at a big 6 bank.


Or course if she hid only 20K hidden away and invested it at 2% on that money it would also be close to that $437.37
But she has NEVER invested a dime in any stock, mutual fund or other platform before or since. The money just sits there in a basic Royal Bank Savings account earning the least interest possible.

Hopefully this convinces this board that likely something has being purposely hidden.

What are the timelines here what is a good course of legal action. I understood it to be 6 years from the date of the final order to recoup from undisclosed assets.
Is it that date or is it when the original disclosure was provided or some other date like pension split date.

Employment income is not always a 000 amount. It can be what you noted. And like I said, if she just started in November of 2019, after the papers were signed, she was within her rights to earn money.

You don't have to convince a board of anonymous strangers, you have to convince a judge to reopen the equalization. If you think this board is hard, good luck with a judge.
 
The judge already said they weren't interested or concerned with the small amount. Like you said, there are so many legitimate reasons for the money; OP is just assuming here.

I think OP is pissed and thinking their ex was sitting on a fortune. Nothing seems to get through to OP that it isn't going to work.

For 5th or 6th time. She didn't have a job!!!
I filed a motion for it in 2022 and they did not comply. The order and file is still open.

I do not understand how my questions on timelines were answered. The only thing I got from this thread is "file a motion but this time with consequences for non-disclosure"
 
If you filed a motion in 2022 why have you waited this long to move it forward?

You think she didn't have a job.

By all means, get going on your motion. If it has nothing to do with child support then you are probably out of luck and that's why the other side didn't respond.
