My ex and I have consented to sever the divorce from other issues. What is giong to happen next? I understand that we still have to file the divorce affidavits and other paper work which may take couple of weeks more. What will be the date of divorce to become effective - is it the date we consented to sever the divorce, date of affidavits filing, or the date the judge formally signs the court order?

Thanks.

We went though this when my now present husband divorced his ex. Both parties agreed to divorce. We had to wait for an order from the judge saying he gave persmission etc and then filed for the divorce including the order from the judge. We received that about 2-3 months after the date of the conference to get the order and file for the divorce and then about another 2 to get the actual divorce papers themselves which were valid one month after the date the judge singed the divorce order itself.

Apparently there is a quicker way to do it if the judge lets you ( at least according to our lawyer). Our judge gave a written order giving permission to sever the issues, which meant filing an extra motion on our part. It added an extra step..but it really went by pretty quickly.

Good luck!
