Divorce File Numbers, etc.

Last week, my lawyer sent me on what has become a wild goose chase. :confused:

He suggested that we obtain a record of my stbx's previous Canadian divorce. There could be information which might contradict claims he is making now - in the year 2013.

So.... off I went to the court house (yike... the lines... the staff tactics to cope with the craziness of that place).... to obtain this record. I had to wait almost a full hour... interesting/revealing things to observe there! :cool:

Anyway, my stbx's last divorce was just before 2000. Therefore, the record is not in their database. They could not instantly identify the relevant file number.

So.... they told me to call the Central Divorce Registry (i.e. nation-wide records of divorce) - 613-957-4519.

When I finally was able to speak with a living, breathing person at that place... I was informed that they would not provide the file number because I was not one of the parties in that divorce. :mad:

They suggested that the laws involved at the federal level are different than those at the provinicial level (i.e. Ontario in my case). They "guessed" this when I probed why the staff at the Ottawa Courthouse assumed that I would be able to obtain that number by calling them.

I then called the "direct" number of the Ottawa Courthouse staff member with whom I had spoken face-to-face initially. Of course, I reached her voicemail only... and she is not replying to my enquiry about what to do now. (She had assumed that I would call and leave the file number along with the other details I already had known.)

Does anyone know about obtaining divorce file numbers - pre-2000, province of Ontario, Ottawa courthouse? :confused:
 
You go to court and ask them for file providing name of the parties or at least one party. They look up it in db on computer or book if it early one and if it not in court hous you fill up request and in week or too they call you to come to coirt house and look it or make copies cor 1 dollar a page.

It should be very straight forward unlees fike is sealed for some reason.

The staff at the Ottawa Courthouse claim that they can do nothing for me until I provide them a file number. Evidently no computer record exists AND the onus on me is to produce this number.

If you know that you can get a "hard copy" file without a file number....then that means that the staff I dealt with were passing the buck.

Is it possible? I'm going to visit there again... but start with FLIC staff.

Crap - the legal system is an a*s... if not the law itself.

If you consult the guide (first link) on the page, it will state that you need a file number but it seems you can consult the index to get that file number.

Also, I would ask, does it really matter what happened in the previous divorce, these are considered two different matter and I am not sure how much would that help your case.

LOL "Offspring"...kind of a weird way of saying he doesn't have any children from previous marriages.

I STILL like to refer to "offspring" as the band..

please dont tell my that you thought your marriage would last forever?? He had a track record of divorce and it was more then likely that you would end up the same way all his exs did. At least they were smarter and didnt have kids with him.
 
Well you are making lots of assumptions that are wrong. Also there are many details unknown to you. It is easy to judge others - too easy online. ; )
 
I've been trying to chase after a file number for my stbx's last divorce. Still trying to crack that... finally it dawned on me... it must be referenced on the application we filled out to marry. (Yes, according to Service Ontario staff. It will be on the long version of our marriage certificate.)

Now I just have to wait 2 weeks and $22 later... I should have that darn number. I bet there isn't even anything in the file that's relevant to my case. But just in case... Certainly cheaper than formal questioning of my stbx.
 
so why is it your lawyer wants you to track down your ex's previous marriages??

how will it help your divorce/separation again??
 
OK to keep this general... stbx has not been forthcoming with disclosure... it is time to press ahead ... I don't want to pay thousands of dollars for him to lie during questioning.

There may be info in his divorce files which will contradict claims he is making now ... that relate to assets he held or did not hold just prior to our marriage.

The thing that ticks me off... is a) shouldn't my lawyer have known that I would NOT be able to instantly get a file number at the courthouse (for a pre-2000 divorce). He is very seasoned... well, old enough to be; and b) I myself don't believe that there will be anything of substance there. Maybe I'm wasting a lot of time and effort on nothing. But, hey, he's the expert and that's why he is getting the "big bucks".

Also I will turn over any stone to get what I need... without exhausting all my assets in the process.

Why not tell your lawyer to ignore the previous file, then go to the courthouse and order it yourself? Do the legwork and save on fees.
 
Yes. I'm the one doing this - a different kind of paper chase. Cost is my time, copying, etc. My lawyer suggested it. However, he did not anticipate all the complications, starting with the one hour wait to find out I couldn't request that file immediately. Thanks.
