Well, the ex is 3 for 3. Court Order made in Sept after Trial a few months prior. So far: he is almost 2g behind. Oct was a couple hundred dollars, Nov and Dec a little more. More than $500 short (and almost 1g on the Oct amt). Order is not w/FRO yet as far as I know b/c the Judge is doing her costs decision (after submissions made, and response to submission rec'd). I (the Applicant) was awarded costs. So yes: ex is breaching the Court Order - but there's nothing I can do (from what I understand). We do not speak but I did recv several off the wall emails yesterday in which ex babbled about "appealing the verdict" - I'd like to see how that works out for him. In our 22 page Judge's decision - her words were scathing re: his credibility, woeful disclosure etc... It was not favorable to him AT all. It was a detailed reserved judgment that was not released for several months. I just can't believe this. I'm short on my mortgage and some bills thanks to him. I truly believe that some ppl were only put on this earth to torture others. Any ideas? Printable ones ?? ;)
 
Once you get the judgement and it goes to FRO, it's their headache. They'll garnish his wages and generally make his life miserable. Mind you that will take WEEKS if not longer to get established, and during that time, he WON'T be paying you. (The second he gets the initial letter from FRO indicating their involvement, ALL payment direct to you stops)

That being said...if you know you cannot count on him to reliably pay the amounts due, why in the world do you count on them for things like your mortgage?

You shouldn't be relying on CS to pay your basic bills. If you cannot live WITHOUT it...you are doing it wrong.
 
FRO is slow i recieved my support order in may and my file was not active till August. With that said they seem to take their sweet time. My payments are now over 30 grand in arrears.Once you have a file number do yourself a favor and document and save everything in regards to FRO.
 
NBDad - read your comments - sound advice but the CS - parent has a place big enough for the kids to have a bedroom. Income is not big enough to cover basic let alone the bigger place for the kids.

If the payee can live without the CS then there is almost a call for it not being required at all? This puts cs paid into the taking a vacation cateogory not living, a roof over thier heads, food..... you know the basic stuff to live. Is this not what CS is supposed to cover?

Here is a general question to all who may add to this post:
How long did it take for your FRO support payments take to start up for them? I understood it took a couple of months for them to get thier act together.

But "justabit" indicated it is now what may to December which is 7 months behind, maybe 4 months since the FRO got the orders, "acive in August".....I just am getting a true handle on what I must plan for but the next thing how many payors will be smart enough to keep the cash to pay the shortfall once the FRO gets thier sh-t together??? What will that be another two years at $200 a month????? People complain about the hardline stance of the FRO but where is the stance to begin with???

Sorry to all but something just doesn't click for someone who just may not be clicking very well these days??

Unfortunately it doesn't work like that. The recipient can be a millionaire and the payor an average $40 Gs, but the payor still have to pay some $300 a month that will not make any difference to the recipient, but to the payor... well...maybe a cheaper apartment ; ) Like in my case my ex lives rent free and practically groceries free at her parents house. Shuldn't that be taken into account that it costs her nothing to provide shelter for our daughter, but part of the cs that I pay is allocated for that?

I'm in school now but for years I was self employed.

Being self employed with a number of different clients, some month I would have lots of work, some months little.

I worked my budget out not on the maximum I earned every month but on what I expected the average to be.

If one month was the minimum, I would hope to make it up during a busy season.

You are arguing that if someone could get by without CS one month then it isn't necessary at all. This is self-serving bullshit.

Some months we have just basic expenses. Other months we have to replace worn out furniture or by new clothes for the kids for winter.
 
My ex is self-employed. I realize there will be no pymts made directly to me once they get involved and that it can and does take weeks for them to swing into action. Ex showed up to pick up our child (llast access visit) in a brand new sports car. Its the 3rd new vehicle that I've seen in 3 years - which is also the same amt of time we were in court. I realize I can't "count" on this money to cover everything but I've incurred some incidentals (expensive school field trips, etc). Also: just in between tenants so normally I have a source of rental income. Bottom line: he was ordered to pay "x" amt of month based on evidence at trial. Bottom line: that's what he ought to be paying. I can assure everyone: there are no vacations being taken here nor does there look like there will be one any time soon. I want to be OUT of court but the bozo just keeps prolonging things - yapping off about appeals etc. He's out of his mind. It's the world according to him - as many of us have experienced the sheer stupidity and lack of common sense our ex's can display. It is only to punish me that he's doing this. I don't get it. He's re-married (thank God!), has new children (both under 2), spends money like crazy, buys new cars - ohhh there's way more but I can't give up too many actual details. It's just disgusting. I'm looking at re-financing, for the 2nd time - just to attempt a recovery. It will be a long, hard recovery. Thanks for everyone's input.

Dd; great points you raised. I don't even want to comment on the last couple of lines that NBdad made. I'm at a loss for words. And I'm pretty sure the ex isn't socking away the shortfall. Rather: he is having us pay for his latest "toy" and the reno's he's doing on the house. But according to him - he's "struggling" - he's "so broke" - No. He's so psychotic is what he is. He's like a forever curse.
 
How far into arrears is he? a little? a lot? If he has a ton of arrears and is tooling around in new sports cars, have your lawyer file for seizure and sale of the asset.

I'm sorry if you find anything I'm saying offensive, but I'm at a loss as to why in the world you would depend on someone who has proven themselves undependable to cover basic bills.

FYI I have a family of 12 living on ONE income, with ZERO CS paid from my ex. If WE can pull it off...ANYONE can.
 
NB dad. No offense taken :) there is a lot I'm leaving out I suppose as I guess I feel if I'm too specific, it will basically be like printing his name. As well, my already lengthy posts, would be even lengthier. As for Sports Cars etc: the ass does not have anything in his name. He puts everything in the wife's name. He is an undischarged bankrupt. A louse. A liar. As for why I depend on this money? B/c for now - I must. I hope it won't be this way for me always: but for right now, things are and have been very difficult. FRO doesn't have the order yet, and I can't send it to them myself. A final draft will be sent _ anyone's guess "when" - by the Courts and of that, I have no control over: I checked.
