My partner and I just had one drafted up by his lawyer that we got back a couple weeks ago. I typed up the clauses we wanted and sent it to his lawyer, who put it in legalese. We have 27 sections to ours, which are outlined as follows:
It starts with the date and stating that this is a cohabitation agreement made on this ____ day of ____ 2012 between __________ and ___________.
Below that is a section of definitions used in the agreement (legal terms).
Then, the sections:
1. BACKGROUND
2. DOMESTIC CONTRACT
3. WILLS
4. REGIME OF SEPARATE PROPERTY
5. RULES OF OWNERSHIP OF PROPERTY
6. HOUSEHOLD CONTENTS AND OTHER PERSONAL CHATTELS
7. NO OWNERSHIP UNLESS LEGAL OWNERSHIP
8. PROPERTY NOT TO BE NET FAMILY PROPERTY
9. RIGHT TO DEAL
10. TRANSFER OR BEQUEST OF PROPERTY TO OTHER PARTY
11. GIFTS TO OTHER PARTY
12. OCCUPATION OF COMMON RESIDENCE
13. SUPPORT
14. DEBTS AND OBLIGATIONS
15. ON MARRIAGE TO EACH OTHER
16. PART II OF THE FAMILY LAW ACT
17. RELEASES AGAINST PROPERTY
18. RELEASE AGAINST THE ESTATE OF THE OTHER
19. GENERAL RELEASE
20. FINANCIAL DISCLOSURE
21. INDEPENDENT LEGAL ADVICE
22. AGREEMENT TO SURVIVE SEPARATION
23. EXECUTION OF OTHER DOCUMENTS
24. AMENDMENT OF CONTRACT
25. PROPER LAW
26. SEVERABILITY OF PROVISIONS
27. LEGAL FEES
At the end is a page for us to sign before a witness.
Are you looking for wording, or what kinds of things to put in there? I can elaborate on some of ours if you'd like. Let me know and I'll PM you.
