Claiming Legal Fees For Tax Deduction in Spousal Support Matters

You cannot claim any legal fees for equalization or getting a divorce. Only for support.

Thanks, that's what I figured. That means that this will probably be my last tax deduction for my support order unless I get taken to court again on a change motion.
 
My lawyer told me for me it was 20% of my bill. So that's what I claimed.

By the way, that seems low. I think I claimed either 70-75% of my bill last year and my lawyer said that some people claim up to 90%. You may want to have another look at what you were billed for.
 
You can only claim for the year you actually make the payment in. You could have an accruing legal bill (like I do) and only pay portions of it. I can only claim, for example, what I actually paid in 2013, on this year's tax return.

You cannot claim for divorce. You can claim 100% for litigation to DEFEND child or spousal support as far as I know. You might have to grind your lawyer on this matter. CRA routinely requests lawyer detailed statements when you claim legal expenses on your tax return.
 
^no this would be for those of us who have "raving lunatic" ex's who take us to court 2 x yearly in failed attempts to have divorce judgement overturned.
