Childcare expense reimbursement

I hope everyone is doing great and looking forward to the long weekend. I value all your input, we might have disagreements but everyone has something to contribute and it is because of this forum I have 50/50 parenting time, thank you.

In 2020 our son was to start school in September and my ex filed a motion requesting me to pay my share of the childcare expense because we both work full-time. The Judge ordered that we split the $630 cost and $315 would be my cost. From September 2020 - May 2023, the $315 was garnished from wages on top of the child support and I paid a total of $10800 for the s.7 expense. The ex never enrolled the child in the after-school program, and on consent I registered him into the martial arts after-school program, paying $190/ month to date and she has refused to contribute towards that cost. In January 2025 I have a motion date set to discuss extracurricular activities and expenses, and my question is can I claim the $10800 since she never registered the child and as far as I am concerned she lied to the courts to get extra money? can I also claim for the $5500 martial arts expense I have been paying?

Were you requesting receipts during the time that the child was supposed to be enrolled? I would think you should have taken this back to the courts a few years ago if you had requested a receipt and were never provided one, or if the child told you they weren't attending the program. I would request that the full amount of your overpayment be deducted from any future payments.

If you are already planning to go to court for reimbursement of your overpayment, I would definitely request the martial arts be split proportionately. There are many factors including whether she agreed to the activity which is sounds like she did.

Thanks for your response. At the time I did not request receipts, my Lawyer at the time had advised me to wait and see if she does not register the child and thereafter bring her to court. During that period I know that our son was not enrolled in the after-school program because both of us were picking up our son from school at 4 p.m. during our parenting time. I did not file anything with the courts because it was during the pandemic and the courts were only addressing urgent matters.

I think requesting that the full amount of my overpayment be deducted from any future payments is reasonable, but is it still possible to request full reimbursement?

As long as you note it and send a formal request it should be. When my husband was going through court we discovered he had overpaid cs (ex wasn't honest about a kid not in school until he demanded transcripts) it was subtracted from the calculations of what he owed.

When you ask for receipts, note it in your message. Example: please provide all receipts for school expenses for the years x to y. Should there be no expenses for these years, I will seek to apply my overpayment to future expenses. If you refuse to provide these receipts, I will assume this is due to no expenses being incurred and therefore I have overpaid for that period.

Thanks, you are my Family, brothers and sisters, I appreciate your contribution, again you have guided me to where I am and you you all have not been wrong in your advice;)
