Ok Currently I'm Paying $1070.00 per month. When we first separated we based it on Min wag at 20,000 and what I was making 80.000 so it was $900.00 per month then the next year she decides to change her mind and base it off of what her return said at $12.500 me 81.000 so it went to $1070.00 she took almost 8 to 9 weeks off of work for vacation/leave.

How does everyone work child support? she is wanting to base it again off of last year when we get to January 1st. I think it should be based on the current year and once you receive your T4 or tax return then it should be adjusted?

Generally, for salaried people it is based on the previous year's income - with some exceptions (like a significant change of income).

For self employed or contracted people (non salaried) whose income will vary month to month, it can be adjusted on the fly, and corrected at the end of the year once the tax returns are completed.

If you have to make any adjustments and you are able to discuss and agree with your ex, put it on paper stating the reason for change, the amounts, and get both your signatures. Two copies.

Ok currently we are going from January to January which isn't really working
We should be going May to May.

What does NOA stand for ?

Also how long can she go just working part time when we have 50/50 custody

The explanation below lays out how you go about calculating Child support (CS). Moving forward, orders usually advise parties to exchange Notice of Assessments (NOA) Jun/Jul every year.



You would use the previous year's tax return to determine this year's payment amounts.

So you should each have your 2015 tax returns and NOA by now.. you can use those figures to determine payments for 2016.

In May 2017, you will use your 2016 tax return and NOA to determine your payments for 2017..

and so on until your support payments terminate.
 
Theres a big BUT here. The federal guidelines state if your line 150 from your taxes is not an indicator of your income then you are supposed to go by the most up to date true info like pay stubs. Technically child support is to be updated on change of income. So if you update june 1 and then you get a raise that changes cs on august 1 you are to update. The reason being that the children are to have the immediate benefit just like they would if the parties hadnt divorced.

Most agreements go by taxes because its easier but as many people have found taxes may not always be the true indicator of income.

If one of your incomes has changed then you both are responsible for advising and updating regardless of it being up or down. DBS is the case this goes on via the supreme court. It shows that there is an onus on the payor to provide updated and true information.
 
1. I would suggest you stop taking advice and direction from your ex.

2. go on the web and search for Child Support calculator for your province

3. email your ex and make the suggestion you agree on a specific date each year to exchange you Canada Revenue Taxation Notice of Assessment and that on the same date each year you both sign the consent to change. Often June 1 with an annual adjustment of July 1. Same as Revenue Canada adjust their benefits paid out.
