Hello - back again.

Father of two sons who will be 16 and 18 in October. My ex is the custodial parent and I pay support. I have not seen my oldest son in 4 years as of July 16, 2010 (not that anyone is counting)

My oldest son graduates high school this June. I had heard through the grapevine that my son did not get accepted to University based on his applications. I checked with the school (joint custody) and understand that his marks are not good enough for University and that his absentee rate is terrible (30 days absent from February 2 - May 25 alone).

I have heard that he is going to return to high school this September to take 2 classes for the first semester (after already graduating) and then 'figure out' what he wants to do.

Is there any advice I could get on Child support and Educational Costs in this case.

I have been here before looking for advice on this same topic - look me up - but the circumstances have now changed considerably again.

Do you have a separation agreement or any kind of court document that dictates support amounts and/or when it ends?

Personally the second he graduated high school I would terminate support until such time as he decides to go to post secondary school. 2 classes in high school does not even a part time student make. If he wants to take them to upgrade his skills, then great, he should be working either full or part time to support himself while he does so. Welcome to adulthood son.

If he takes the classes and is able to get into a community college or something, then at that point I would say make some sort of arrangement to assist him in that endeavor.

I think your Legal obligation is up. He is graduating and is therefore an "adult". If he chooses to continue in highschool part time, then he can also work part time.

I do think you should still on planning to support him if/when he attends post-secondary, but you aren't helping him to move forward by supporting him in part time school
