Changing Child Support Payment Amount.

Can someone explain how I go about enforcing my ex to pay child support based on his current salary. He has paid the same amount for 2 years despite his salary increasing. He sends his money to FRO and Fro pays me. I am of the understanding that I would have to file a motion in court asking for a change in our court order dealing with that specific issue . Is that correct? Everything else is going smoothly. I don't want any more legal bills and feel confident in filing a motion myself. Do I file a motion to change or file a motion asking for payment only. Thank you so much.
 
You can speak to your caseworker at FRO to go through their update forms but your ex has to agree. If they arent agreeing youll need a motion to change. If he isnt updating based on income he wont win refusal of the MTC in court and you could argue for costs.

My best advice is to start with your FRO caseworker. They will tell you what forms to go through them. Then speak to your ex about updating without involving the courts. If they dont agree or put up a fight youll have to explain that court will be involved and you will seek costs.
 
Ill add that this is what my partners caseworker told him. That his ex could work with her caseworker on an agreement form they have to update. Otherwise they would need a court order. The lawyer said that could be done either via motion to change or an order for support.
 
When we do this Consent Motion to Change Child Support, How do we fill Form 25 out? Do we have to fill all that information in/creating a draft order that we want the judge to sign?

Or do we just give 5 copies of form 25 with our information/case number.....and the court fills out all the information on it/words the new order?
