Case Conference and settlements...

To all that have been through this process before....

How many have either given up or came to some type of agreement at the case conference ?

Do people seriously consider what the judge has to say and "give in" or come to a realization that going any further won't be necessary?

Keep the faith!! Its all part of the game and if you walk away and give in it just makes it easier for the other party..hang tough it sorts itself out in the end!!!

I'm just hoping that when she hears the judge talk about equalization, that it will finally click in to her that she has no choice....

So long as the justice is focusing on core issues, and the the issues seem clear, a justice can be persuasive. Unfortunately many conferences (like mine) become ax-grinding sessions with a bunch of orders on the endorsement. My conferences didn't even touch on the issues at hand.

In retrospect, I should have asked the judge to weigh in on opinion earlier to try to cut it short.

Remember that the justice does not control the proceedings, the litigants do. You have to stand up, and direct the proceedings where you want them to go. If you want a subject addresses, ask for it. Ask the justice leading questions like: "Can the justice please explain the foundation of equalization payments in law and their general applicability in this case?"
