My ex is on WSIB, and so he doesn't pay taxes. DRO informed us that his CS should be calculated based on the amount of income he would need to make in order to have the net income that he gets from WSIB. Does anyone know how to do this?

His current income is about 1200 biweekly. That is what he gets. How much would it be "before tax" (gross I guess)

Thanks! I need to know so I can change payments July 1st.

I don't think it is taxed income but i am not 100% sure so i think it'd be 1200 x 26 = 31,200....but don't quote me.

no, the dispute resolution officer told him that he would be paying based on what his income would be, IF he had paid taxes. She said it would be somewhere around 43K, but that I would need Divorcemate to calculate the actual amount.

with both of us being self-rep, I don't have access to that software.

Here is what I did.
1. I calculated the income he would have earned on the first 2 months of the year, before he was on WSIB.
Because I have his income info from last year, same company, I just took his Line 150, divided it by 52 weeks and then got an estimate of his gross income for those 8 weeks.

2. I know his net income while on WSIB, and he also told me and the court that he was earning 85% of his wages.
I took his line 150 from last year, multiplied by 0.85 (85%) and then divided that by 52 weeks.
Then I multiplied it by the remaining 44 weeks of the year.

3. add them together to get estimated Gross.

4. check that against what he is earning now and reported to the court with a biweekly paystub.
Since he mentioned that he was overpaid by WSIB for several months, I know that they are deducting money off this paystub to pay it back. (Of course the stub doesnt show it though!)

5. Check CS support table and REJOICE that I only have to increase my monthly offset payment to him by 71 CENTS for 2012.
!!!:D

it seems that "someone" jumped the gun assuming that I should be paying them a lot MORE CS, all because they FAILED to et proper legal advice before filing in court!!!

oh, and I checked all of it using a tax website. Printed it out, and it is close enough and should be good to use in mediation next week.
