After 12 years I now have sole custody finalized!

My case is finally finished.

We had an appearance for my motion for summary Judgement. Children Aid was supportive of my position. The other side didn't want it and was asking for an adjournment. I tried to fight the adjournment but judge granted it. After her lawyer came to ask me if I would settle.

So Myself, my wife, and children's aid, sat down and created an offer we could live with. Mom ended up accepting it for the most part.

I have Sole custody. Mom will be moving to semi supervised, and then to limited unsupervised access 1 visit a week for a few hours, and alternate sat for a few hours. If mom acts inappropriate, child makes any disclosure, or behaviours regress she moves back to supervised access.

Her signature has been dispensed with for all documents, and travel consents.

Mom does not get any special holiday time. I also have an order that if child's activities fall on mom's time visits can be missed but some make up may be given when available.

So for all the fathers fighting. I went from not being on birth certificate and limited access to full custody.

Our child is so thrilled and told everyone that works with her how much peace they feel now.

Mom has been more civil so praying this finally is at an end and we can be civil and peaceful for our child.
 
This is great news. Your daughter has been through so much. Hopefully she can start to heal emotionally. Good for you for fighting for your child. You are an example for parents everywhere!!

Hey Arabian! Thx for asking. Trial in May. Got delayed in Jan due to medical issues. Been a crazy process but feeling good about May. A lot has happened even during this in-between time frame that should help. Thx again for asking.

I'm on the same road map but I will eventually get there. I know that unless I set sole custody to myself and supervised access to mom as a goal, that I may never get anywhere close to that.

Is there a specific case law that will dictate this in a recent judgement? I could use this in my coming trial in May as D14 won't speak and see me since last August. PAS was confirmed last January when I got the report from CAS.
