$5000 to file for divorce!?!

Nothing if you do it yourself assuming and it's uncontested, otherwise you need a lawyer.

If your being asked to pay $5000 that's ridiculously high. Shop around, especially if it's uncontested - it should not cost any where near $5K

Joint Application means that both parties bring forth the Application in unity or harmony with the court as per the Family Law Rules. Your Separation Agreement can form part of the final judgement.

Use one year separation of living separate and apart as grounds.
 
So what is my lawyer talking about at $5000? The lawyer states that ex is open to an uncontested divorce.

LOL - Its called a retainer and both parties are a walking ABM. You seem to be reasonable and the other party as well. Discuss the mutual goal together and bring forth the Joint Application together. All the forms are online.

Attach your Separation Agreement as an Exhibit to your Affidavit. The FLIC located at most court houses can assist in the completion of necessary forms. The Application for Divorce will have to be considered by a Justice and decree granted.

Piggybanktoex - If you guys are in agreement, you don't need lawyers filling out a form you can both do on your own. Then you can both have it reviewed by a lawyer that would represent both of you to end the whole matter amicably. Nobody wins when lawyers are involved and nobody wins the day you step into court. The only winners here are the lawyers.
 
Go down to the courthouse and pick up the forms for a "simple divorce". As long as you have been living separate and apart for 1 year, it's pretty automatic that you'll get it.

Total cost (at least here in NB) is around $125.

Attach your separation agreement to the forms, for the sections for division of assets/debts and custody (if applicable) and support (if applicable) reference to your separation agreement or existing court order.

You file the papers, serve her, and she can stall for at most about 6 months. Then a bloody CLERK can sign off on it.
 
Had a pretrial to resolve a few issues and the D cost was around $5k so that seems cheap. Not many have a fairytale no contest D. Imagine Divorcing and agreeing to everything like the day you got married. LOL If we could divorce the person we married there wold be lawyers and judges lined up at every food bank in the country.
