5 years of income returns?

Does anyone know how you might try to get 5 years of income verification as opposed to the 3 called for under the Act? Needless to say, his income dropped dramatically once we split, and five years would be a better indication of his earning ability. :)

You request it from opposing counsel, in writing, indicating date/time you expect it to be provided to you. All t4, t4a's, all original invoices/statements of income and business expenses. If he is self-employed you do not want to use the 150 line of his income tax return - only use that if he was an employee. Self-employed you can also ask for his company financial statements.

Why do you want him to pay on ability and not on what he actually makes?

Seems unreasonable unless there is more to the story.

I get what's happening---my ex is doing the same. Ex's cut down their work hours (3 days a week from his 4----!!!); long long holidays; etc. so that his income is lower and thus can't do support etc.

I was able to get my tax returns from 1988 and 1989. I think you can only go as far back as 1989 now. Your ex could get the same info.

There always is mate, and that is the part that people tend to leave out for obvious reasons ;)

You can get all the information you want, but unless a judge wants to accept it, I don't think you accomplish much. You would have to be able to prove that he is deliberately underemployed, and that might be a challenge.
