Hi,

Can someone in the group with an example explain us what makes 40% to 50% of the time with the child?

He wants to know how percentages are calculated. I gave him a calculation using hours and he was not a fan, so he wants a second opinion.

Overnights are often used, but his agreement had some very specific timing which led me to believe that a judge might count hours.

Either way, ensuring 50% is easy. Just make sure that the schedule is symmetrical. Then you don't care how the percentage is calculated.
 
Agreed. There is no cut and dry way to calculate time. I was told by lawyer most judges use overnights per 2 week period. But all depends how agreement is written, especially as it relates to calculating support. Best to have it explicitly written rather than leave it to guesswork.
