2nd Income Impact on CS

My divorce wiped me out financially. A few years back, I took a 2nd job moonlighting at a trivial-type job to help make ends meet. As a result and playing by the rules, I was paying additional CS due to the added income. I hid nothing. I left the 2nd job as things improved.

Fast forward to a few years later, and tables are turned where now its my ex that is working a 2nd job to help make ends meet. However, sleuthfully, paid under the table and likely via e-transfers. We calculate child support annually in accordance with our tax returns. Anything I can do to get a break? When I get their tax assessment, can I not say "don't forget about the money you made at your other job"?
 
If you have proof they are being paid in cash (for instance they have a storefront page on the internet or Etsy page or sell stuff on FB marketplace you can argue that it be included. If you took it to court you could ask for bank statements to show cash deposits. That would require court though and you would have to pay money to argue something not worth much.

If you can't prove anything then it can't be included. Which is why you do a second job for cash under the table. Can't be traced, can't be included!
 
I would not have included your second job as spousal/child support. Nobody should be expected to work a second job to make ends meet. You should have kept all that extra money. I id the same thing for awhile and I never paid child support on it.

Having said that now that you've paid on your second job when in my opinion you shouldn't have, she should have to do the same or reimburse you for the extra child support you paid on your second job (this is the route I might be inclined to pursue). Then tell her she can keep whatever she earns at her second job.
