  • where does spousal support criteria meet self support?

    Below is a copy and pastr from government website:
    http://www.justice.gc.ca/eng/fl-df/s...ux/ss-pae.html

    Judges must also consider whether spousal support would meet the following purposes:

    to compensate the spouse with the lower income for sacrificing some power to earn income during the marriage;
    to compensate the spouse with the lower income for ongoing care of children; or
    to help a spouse who is in financial need if the other spouse has the ability to pay.
    At the same time, the judge must consider that a spouse who receives support has an obligation to become self-supporting, where reasonable.

    So where do these 2 ideas intersect?
    If you have 2 spouses who entered marriage with same earning capacity, with same qualifications, for same field and could have same job with same pay, and then eventually one continues career, gains further qualifications/degree, advances career, while other stays home to raise children for many years, then reenters work force at separation, how do you reconcile compensation vs. self sufficiency?

    Is it based on a certain length of time, or is it based on the the difference in earning potential due to one having career advancement and one not ( it is about a 40% difference in earnings currently, and likely change to about 25-30% difference in a few years, or is there a certain wage that is considered self sufficient, so once the lower earning spouse reaches that threshold, then spousal support stops? I am just not sure how figure it out?
