            See assumption about the income tax made by a single person make you believe we ripped the system. She settles her debt with the CRA this is not what I wanted to discuss here. And no it was not like the wild asumption and calculation made here without knowing a single thing about how much we made etc.... The income tax is not an issue here, the issues was wheter or not someone could claim survivor benefit after separation. Yes I have made an application and my intention was for her daughter. I am not sure if this will be accepted by the government. But that would be advantageous (mostly to person receiving support) to a person that tried to get back on his/her feet after divorce. Of course there should be limitation.

            During my separation I did not provide my income tax statement until we started negociation with a province appointee present, so really it never got to the judge. But my pay guide and pension guide did, he look at the financial disclosure form as well. This is how he figures out how much for the spousal support. I also learn that a judge cannot change the law, but he can change the judgement. It is up to the government to change the law.

              She may have settled her debt with CRA, however unless you filed to have your taxes amended as well, you did not. This is where the issue lies and why everyone has commented on how you misrepresented yourself as single. How much money either of you made is entirely irrelevant to what you're asking.

              You did not recognize her as your spouse to the government and now that she's passed you are attempting to take advantage of a federal government credit as her spouse. In doing so, you are telling CRA that you either misrepresented yourself in the past by claiming to be single or you are misrepresenting yourself now claiming to be her spouse.

              Your question has been answered multiple times in multiple ways that all come down to the same answer: based on how you failed to claim her as your spouse in the past you are not entitled to claim survivor benefits. If however, you amend your misrepresentation of your past filings and settle YOUR account with CRA, you MAY be entitled to claim the benefits. In the meantime, you are attempting to justify your actions to the rest of us, who as taxpayers, are and have been shouldering the cost of your misrepresentation, and expecting us to be ok with it. As you can see from the multiple responses in this thread - WE'RE NOT!

              Your argument that because she made a poor moral decision to have false charges brought against you justifies you making a poor moral decision in claiming a benefit you are not entitled to (at the expense of the the rest of us) is nothing short of disgusting. Ever hear the saying 'two wrongs don't make a right'? Even young children understand this concept.

              You asked for factual information, you were given so by multiple people including a registered tax accountant who deals with these issues for a living and yet you still want to try to justify yourself. What more is it you actually want?

              If you want someone to agree with you to make you feel better regardless of what the truth of the situation is, then fine: I agree with you, you should totally file a claim and you are entitled to recieve the credit.

                A wild assumption? I don't think so.

                If she filed single and claimed the eligible dependant amount, I can be sure that you two ripped off taxpayers of this country for $15,000 over 10 years. And if she received any CTB payments (that would be a yes unless her income alone was greater than around $80K/year) at all over 10 years you were together, then you two further ripped us all off by failing to include the effect of your income.

                How many times must you have it beat into you? Notwithstanding that a judge wrote it into an order (probably for some other purpose e.g. health insurance benefits) you were not common-law partners at the time of her death. Sorry about your luck.

                              I already went thru that program and the CRA has an order from the superior court and it mentionned all the details as I forwarded this to them. Our separation agreement was drafted aferward. Remember "she settles her debt with CRA" anyway I am not here to discuss my separation details and neither my life. The only discussion I wanted to share with people is whether or not after separation an ex spouse would be eligible to survivor benefit if one died. And this depending on what a judge wrote on a separation agreement. That is what we will find out later as I am not running to the post office to retrieve this application. I did not have a discussion but instead attack and accusation based on ignorance of my whole case etc. The quote refer to family law. It is changing and will continue to change as judge make judgement on fact presented to them and interpretation of the law. I would have much prefer to have this discussion in french as this would have been easier but now that you know that I am french I will expect some comments on that as well unless you prove me wrong. Remember I was accused of being a criminal. Interesting would you say!!!
