    Hi all,

    so I was late in serving a SC brief. Both the OCL and the STBX's lawyer were served. The OCL has consented to the late service but STBX's lawyer not.

    In order to file, do I need both parties to consent ?

    In order to file, do I need both parties to consent ?
    Yes. If a document was served late you need one of:
    1 - consent of all parties; or
    2 - leave of the court (ie, an order); or
    3 - an inattentive clerk.
