  • Offer to settle question

    Once an offer has been served, I don't file it anywhere in the court record right? How is it viewed by the judge at the end? Thanks for any answers in advance.

    Your offer to settle is served on the other party’s lawyer or on them if self rep. You keep proof that you served them and you keep a copy. Then you wait and see whether or not you actually get to trial or arbitration. If you do ( which can take ten or more years to actually get to) and an final order is made...then the judge will look at the offer(s) when determining costs (if any) are payable and to whom.
