    Hey there

    So the mother of my child and i both had non removal orders in our applications. However, the mother now threatens to relocate (from ottawa to hamilton, On) with our child right before a motion date.

    Is that even legal?

    I dont' know but this is what I was told:

    lawyer: a clause telling you were you have to live is unenforceable.

    3)
    lawyer: if it infringes on your access that is a factor.

      Is your original motion for custody and within it you requested that she cannot move with child? Or have you filed an emergency motion to stop her from moving?

      Either way, if she is threatening to move and you have not had the case heard yet then she can threaten all she wants. As long as your motion includes a clause to prevent her from moving without permission it will be heard.

      Do you have a lawyer? Have you spoken to them (if yes)?

      Ex’s like to threaten a lot of things. As long as you are going through the process then their threats are mainly words. Make sure your motion includes that she cannot move with the child.
