I would like to know if I have any chance of getting custody of my daughter.
One year ago, my ex and I separated. He worked steady night shift and I thought with me leaving he would change his shift to days. We had no written agreement as to the custody of the children. I was moving 6 hours away and didn't want to change their routine and uproot them from all they knew. My ex did not change his work hours to day shift and therefore my 16 year old is responsible for his sibling at night and has no life because of this. My son is 16 years old and has decided to stay put as he has only two years of highschool remaining, and I respect his decision. My daughter who is 12, asked to move.
I asked her if she was serious about her decision, and she said that she "Loves her father but needs her mother". She is very independant but needs supervision for school work and her health. So I asked her father and he told me that I was the one who left the family and he wouldn't be paying for it (he doesn't want to be alone).
He refused me access this summer until I had signed a letter stating when and how the children would be returned. I speak with my children everyday, and have seen them 4 times in the last year as it has cost me 1K in travel every time I want to see them. My salary is 32K and his is 115K.
My ex is looking to sell the house where the kids live and they will have to change schools.
What are my chances of getting custody of her? And at what age can she decide to move?
