  • Is it true...CS to be deductable to the payor

Someone mention in passing today that there is talks of Child support being deductible with the CRA? Anyone can confirm or deny this

    It is not deductible.

Spousal support is, child support is not.

That is, unless you have an agreement/court order for child support that is made prior to 1997, I think it's May something.

Also: If children are involved, CRA *requires* you to inform them of the amounts paid for CS as well as SS, because as far as CRA is concerned dollars paid go FIRST to satisfy the CS obligation, and THEN to SS.

This is consistent with their "children come first" policy.

Example: If you inform CRA only of the amount you paid for spousal support but you also pay child support, CRA will credit the money you paid for spousal support against your child support obligation first...and will not necessarily assume that you paid *any* spousal support...and you won't see a tax break for the spousal. That's why they ask for both amounts.
