  • Adult child's income taxes

    The adult child (20+) attends post secondary education. Over a year ago, the courts ordered that the parents pay 100% of education expenses as well as tabled child support because at that time the adult child had no income.

    The adult child now makes a good income and because they are going to court anyway to modify child support, would like to readdress the issue of the adult child contributing to their education expenses.

    What is the process for obtaining proof of the adult child's income through the courts as the documentation will not be handed over?

    You could question the adult child under rule 20 of the Family law Rules and request that they bring any document that you think is pertinent or as an alternative; You could name the Adult child a 3rd party to the action.
