  • Child support: where do we stand?

    May 2018: The judge imputes the ex minimum wage as they claim they are not working - CS is ordered accordingly.
    Jan 2019 : ex starts working - doesn't provide financial disclosure by June as ordered the year prior, I request permission to bring contempt motion - judge denies permission.
    June 2020: ex sends financial disclosure (ROE) showing job terminated on March 16th due to medical reasons. however, she made a bunch more than the minimum wage when she worked.
    What do you think is the right offer to make? Pay CS on income earned from Jan 2019 to March 2020 and then minimum wage? something else? I am not sure ATM.

    The contempt motion was silly. You should have motioned to impute income.

    Give her the option for how she wants to support to be calculated:

    Option A: Previous year's earnings as shown in NOA

    Under this option, her job loss is immaterial at this moment, though it will reduce child support next year.

    Option B: CS is based on the current situation

    That means that she owes you retroactive CS. Once she has paid the retroactive support then by all means you can switch calculation options.
