  • Can we ask to skip settlement conference?

Need some advice. A friend had filed a motion to change few years ago. The form at that time was not the 15A form, instead it was done as a motion and had to go through settlement conferences etc. For a year parties were in court and then they had an out of court settlement. Meanwhile whenever there was a court date for settlement conference it was just adjourned to a later date. This adjournment happened continually for a few years .

Fast forward to now. Mother wants to file a motion to change however when she went to court she couldn't file one because the old motion to change file is still open. She was advised to file an amended motion to change.

Again she went to get a court date for the amended motion to change and was told that she has to get a settlement conference date which should be mutually agreed date and if they cant then do a 14B to ask for a date.

My question is that why do we need a settlement conference? This motion to change is after six or seven years from the old motion to change. Things have entirely changed . Motion is to adjust child support and should be an easy thing.

Is there any way that she can ask to skip settlement conference and her motion to be heard and decision made . Just like the regular motions , file and get a date and case is heard and temporary orders are made.

She doesn't want to be stuck in the long process of court when her only issue is to adjust child support. Shouldn't it be just a simple motion? How should she proceed in this case?
    thanks
