It's in the federal income tax worksheets somewhere...if there is an order for both Spousal AND child support...then the Child Support CANNOT be in arrears. If it is, then the payor is NOT allowed to claim the full Spousal support amounts. Government operates under the assumption that CS is paid before Spousal, always. So if you have a pending credit for 12,000 for spousal (1000/month), but owe 10000 in back CS....you get to claim 2000 for spousal, NOT 12000.
Something like that anyway.
